Exhibit 12 Tab 12 Sr. Jane Gerety: “…we should pass the hat immediately.”

Baker Donelson Attorney Steve Hall filed Exhibit 12 along with 27 others in Judge Craig Schwall’s Superior Court of Fulton County on July 11, 2014. Judge Schwall responded with a ruling that permitted attorneys for Manny Fialkow to move toward the dispossession of the property in question, the Peachtree-Pine Center. Also the Judge affirmed his Special Masters’ ruling that asserted that defendants Fialkow, Central Atlanta Progress and Atlanta Downtown Improvement face eight claims that need the decision of a jury. The following four e-mails were written and sent on November 12, 2008. They show the collaboration among TEAM GOLIATH members, the Nun-run Mercy Housing, Inc., The City of Atlanta, Central Atlanta Progress, Atlanta Downtown Improvement District and Emory Health Care, Inc. Steve Hall entitles Exhibit 12, “Sister Gerety email to Diane Leavesley.” I have quoted the four emails verbatim in the order they were written.

“From: Gerety, Sister Jane
Sent: Wednesday, November 12, 2008 9:14 AM

Subject: call

Julie,
I got your voice mail. Thanks. I wanted to talk to you about the possibility of foreclosure on the Peachtree and Pine property in Atlanta. I’ve talked with Pete (Walker) and with others representing the city and believe that foreclosing is what we should do. It needs to be part of a plan to move the men living in the shelter to other facilities where there are supportive services and a proposal from Mercy Housing for affordable housing on the site. There may be some negative publicity, but I think that can be mitigated by the plan and the proposal. Moving the men is very doable and represents a philosophy that is much more enlightened than warehousing them in the present facility. In addition, if Mercy Housing can accomplish this, I believe we will be in the debt of the city, the business community and the foundations. Horace Sibley, who chairs the Mayor’s commission to end homelessness, told me that if we can get this accomplished, we should pass the hat immediately.

That’s the gist of what I wanted to talk about, but if you get a chance, and I will fill in more details.
Safe travels,
Sr. Jane”

Handwritten notes by Diane Leavesley, Head of Mercy Loan, Inc. during a conference call follow, ”Anita’s vision meets people where they are; Horace wants to get people out of homelessness.” “1 by 1 her funding sources have dried up; a proposal to rehab the building to maintain the shelter w/SRO hsg above.” “Foreclose sensitively & delicately; Horace has a plan to move men.”

Note: Diane Leavesley’s notes read that Anita meets people where they are. That is true; however, her note implies that nothing but sheltering takes place. Every day of the year for 17 years the Peachtree Pine facility has provided, intake and assessment, case management, three recovery meetings each week, GED classes, basic computer-skilled classes, computer lab: job search, resume building, COMPASS access, e-mail access, clothing closet, weight room, resident volunteer training and housing, transitional housing program, art studio, roof-top vegetable garden and a monthly health clinic. Sister used TEAM GOLIATH’s favorite term, “warehousing.”

There remain monolithic differences between Horace Sibley, Debi Starnes and the Task Force. The Metro Atlanta Task Force for the Homeless, Inc. has fed, sheltered, clothed and housed hundreds for years while Horace Sibley and Debi Starnes worked feverishly to crush every move of the Atlanta Task Force. Neither Horace nor Debi nor United Way nor the City has ever had a plan to house the men at Peachtree-Pine. Their plan consists solely of disappearing people unsightly in their kin.

Don’t miss Good Sister Jane’s exclaiming with glee that the City, the business community and the foundations will all owe the Nun-run Mercy Housing, Inc. if these sisters, married to Jesus, “can help to accomplish this” the shutting down of  a shelter for homeless people.   Sister Jane Gerety did more than pass the hat. At the time of these collaborations the Nun-run St. Joseph’s Hospital in Atlanta was going belly up. That defunct disaster got bailed out by none other than conspirator Emory Health Care, Inc. I look at Emory’s new sign often. Today it is Emory St. Joseph. Pass the hat, please.

Last night, September 2-3, 2014, forty-two children with their mothers spent the night on mats at Peachtree and Pine. Calls from well-wishers and do-gooders alert us that we are to be evicted soon We’ve received these calls for 5 years. Some are TEAM GOLIATH pranksters; some care that homeless people will be left at the mercy of United Way. Come now BEFORE the Court closes the doors. Come now before Emory swallows the place. Come before Manny Ahab steals Naboth’s vineyard. Why wait United Way? Why wait Fulton County Commissioners? Why wait urban and suburban churches? Why wait Synagogues and Mosques? Why wait travelers aid? Why wait to reopen, Gateway? We welcome you all. You come and succor the 100 perishing ones. Please come, Sisters of Mercy!

Daniel and his three Jewish buddies, Shadrach, Meshech and Abednego are vegetarians and do not eat King Nebuchadnezzar’s cheeseburgers or French fries. The four are captives taken from Jerusalem when the Babylonians burned the Temple, leveled the palace and carried 10,000 Jerusalemites off to captivity in 587 b. c. e. Nebuchadnezzar is a butcher and a self-proclaimed doer of all good. Any wonder he had bad dreams. He called in all his wise men, downtown geniuses, soothsayers, priests and anybody he could find who might interpret a particular dream. Because Daniel and his three buddies were brighter and stronger than the Babylonians around them, King Nebuchadnezzar placed the four men in his service. Because Daniel tells the king his dream and the dream’s meaning, he is well known in the kingdom as an interpreter of dreams and strange events.

Chapter 5 of the Book of Daniel in the Hebrew Bible, (Jewish theologian Marc Ellis correctly calls it The Older Testament,) relates this story of King Belshazzar and how the fingers of a man’s hand write words on the wall. If you enjoy a chilling story, read on. If you are a practicing member of the TEAM GOLIATH conspiracy, you might not want to read any more. If you love justice and pray that somehow, somewhere, someday it may prevail, read the fifth chapter of Daniel. Babylonian King Belshazzar is Nebuchadnezzar’s grandson, not his son as Daniel reports. Chapter 5 describes how Belshazzar gave a great banquet for a thousand of his nobles and drank wine with them.

Belshazzar’s party brings to mind Herod’s Antipas’s party where John the Baptist’s head is brought in on a platter at the request of Salome. My blog entitled “The HAG Delivers Again” features a similar Shirley Franklin party where Debi Starnes is urged by the Mayor of the golden tresses to bring in the head of the troubling, Anita Beaty, the truth-teller who refuses to obey the empire. This is a Swiftian modest proposal. It’s called satire and not history as some moron at Franklin’s City Hall implied. That is a blog I posted on 13 April 2009, entitled, “The Hag Delivers Again.”

Daniel 5:8 reads, “Then all the king’s wise men came in, but they could not read the writing or tell the king what it meant. So King Belshazzar became even more terrified and his face grew pale. His nobles were baffled.” The word “baffled” is a synonym of A. J. Robinson’s word, “mystified.” He used that with a reporter from the ATLANTA JOURNAL CONSTITUTION in responding to Debi Starnes’ invention years ago that a “lice-infestation” was occurring at the Peachtree-Pine Community. See my piece entitled, “What’s In A Middle Name?” posted on 19 April 2011.

At Belshazzar’s party the nobles are baffled. At Central Atlanta Progress the noble A. J. Robinson is “mystified” by the report. Those of us who follow Starnes’ yarns were not able to “interpret” Robinson’s word: “mystified.” Was good A. J. confused by the Homeless Czar’s lie or by the possibility of a lice infestation. Whichever, Fulton County Health Department set straight the record by refuting Starnes’ fabrication saying to the press that there was no infestation of lice present or past at The Pine.
Belshazzar read the handwriting on the wall, “MENE, MENE, TEKEL, UPHARSIN. Daniel came and interpreted,” verses 26-28 of Chapter 5: “God has numbered the days of your reign and brought it to an end. You have been weighed on the scales and found wanting. Your kingdom is divided and given to the Medes and Persians. Daniel 5:30 closes the book on King Belshazzar and his particular chapter of the empire, “That very night Belshazzar, king of the Babylonians, was slain, and Darius the Mede took over the kingdom, at the age of sixty-two.”

Suddenly the fingers of a human hand appeared and wrote on the plaster of the wall, near the lampstand in the royal palace. The king watched the hand as it wrote. His face turned pale and he was so frightened that his knees knocked together and his legs gave way.

Is the handwriting on the wall? Will a jury of their peers hear evidence that exposes Central Atlanta Progress, (CAP); Atlanta Downtown Improvement District, (ADID) and Manny Fialkow’s Premium Funding Solutions of TORTIOUS INTERFERENCE and the RICO Act RACKETEERING against a HOMELESS shelter? Will the trial set for November 4, 2013 really take place? Will the lampstand in the royal courtroom reveal the conspiracy? Is the handwriting on the wall? Could power brokers and movers and shakers who have dodged being deposed for two years have to face a jury of their peers? Is the handwriting on the wall?

Will thousands of documents sent back and forth between the City of Atlanta and all the accused bubble to the surface of this cesspool? Is the handwriting on the wall? The principalities almost always win; however, empires crumble, always. Your good ole boy system in Atlanta runs deep and wide. But on rare, very rare occasions, justice prevails even in Atlanta. We still have two boxes, the jury box and the ballot box. Somehow, just somehow perhaps, justice will prevail. Oh, Lord, what a morning when the stars begin to fall.

My friends, some of my neighbors and several of my relatives chide me gently for my speaking of “God’s burning rain,” Atlanta as “Sin-City,” “when the stars begin to fall,” and now Daniel’s “handwriting on the wall.” I know that the City of Atlanta has the protection of a federal judge in a ruling called sovereign immunity. Of course the City as a tool of TEAM GOLIATH carries the club’s water. The Club’s water carrier has to be protected too.

Everyone knows you can’t sue the king even when he murders two of his wives. And if every judge in the EMPIRE renders the principalities and powers “IMMUNE,” there is still a higher court. There’s Jim Lee Scott’s and Dr. King’s arc of the universe. The hundreds of women and children homeless and helpless on the streets of Atlanta INDICT City Hall, City Council, the Innovation $3.3M Delivery Team, The United Way, The Gateway, The Gateway Board of Directors boasting such luminaries as Jack Hardin and Little Miss Debi. Is the handwriting writing on the wall?

Emory University and Emory Health Care, Inc. face a similar lawsuit in the Superior Court of DeKalb County. The charges they face are basically the same as those of the downtown conspirators. Emory is by far the largest member of TEAM GOLIATH. How could snow-white Emory be involved with disappearing a shelter near downtown Atlanta? Emory Hospital is located almost directly across the street from The Pine on Peachtree Street. Many of the uppity ups in the Emory hierarchy break out in hives at the thought of Peachtree Pine being located so near. Its food court is off limits to any of the residents of the Peachtree-Pine Community. And closely following Emory’s hatred of Black men surfaces its love for a 96,000 square foot property facing on hallowed Peachtree Street. Is the writing on the wall? The connections between Emory and the nun-run Mercy Housing, Inc. and Central Atlanta Progress and Manny Fialkow and the SOVEREIGNLY IMMUNE City and Emory University and Emory Health Care, Inc. are a matter of record. Is the handwriting on the wall?

The King James 1611 translates the chilling words, “You are weighed in the balances and found wanting.” The NIV reads, “You have been weighed on the scales and found wanting.” The scales of JUSTICE never balance for conspirators such as TEAM GOLIATH. Is the handwriting on the wall? The most recent atrocity of TEAM GOLIATH flooding the streets downtown with homeless women and children is beyond description. Emory Health Care stands accused by innocent little children who don’t know where they will spend their next hour. The Gateway Board of Directors closed its doors to ready itself for the men at The Pine when Manny Fialkow and our judicial system finish the job of stealing the building. (See my piece, (“Naboth’s Peachtree Pine” posted October 26, 2011) The nuns of Mercy Housing, Inc., a huge arm of the conspiracy, have joined hands with Horace Sibley and Manny Fialkow to force Peachtree Pine into foreclosure. One nun wrote (I have the e-mail) that the City of Atlanta will be in Mercy Housing’s debt for helping to put them in foreclosure. Imagine the NUNS of mercy and MANNY FIALKOW as bedfellows. Is the handwriting on the wall? Oh, Lord, what a morning!

City office of Grants Management

On the first day of Christmas, Horace Sibley sent to me a family living in a pear tree.  Many months ago Horace Sibley’s daughter, Eve, emailed me from across the sea saying that if I knew her father I would not write what I had written about him.  Had I had the opportunity to speak with Eve Sibley, I would say to her what I said to Debi Starnes at Manuel’s Tavern, “What I write is not personal; it’s spiritual.”

Sibley, an attorney retired from King and Spaulding in Atlanta, served as the first chair of Mayor Shirley Franklin’s Commission on Homelessness.  That misnamed and misbegotten body has lived through many phases.  Under the cover of night, Franklin while Mayor slipped across the street from City Hall to the Georgia Legislature to get the vote to make her “commission” an authority.  She got the vote and immediately she got also a veto from Governor Sonny Dupree.  Franklin and Sibley wanted state money that could have come if their little creation could be made an authority.

During the early days of serving as chair of the mayor’s commission, Horace Sibley frequented the Peachtree Pine Community regularly, always with note pad in hand.  He brought Eve, an accomplished portrait artist to the Art Works Studio.  She painted in our studio the faces of many residents.  Horace told me once that he was a friend of Peachtree Pine, and we had his support.  He knew he was bearing false witness, and I thought of THE ODYSSEY.  In addition to bullying frightened homeless women, he is Horace “Sinon” Sibley.

He took his twisted version of what he had learned at Peachtree Pine to the Outreach Committee at St. Philips Cathedral (Episcopal) and that body of believers cut funding to Peachtree Pine ($30,000 annually).  He took his notes to TEAM GOLIATH and Debi Starnes.  His fellow conspirators like A.J. Robinson and Tennco’s Brad Curry and  Emory Health Care’s Al Blackwelder and an entire entourage of movers and shakers drove  in a Central Atlanta Progress van to visit Dan Cathy at the Chic-fil-a headquarters.  Soon, miraculously, all Cathy money stopped.  Chic-fil-a’s moo cow band was seen no more at Peachtree Pine.  The training of new employees coming to the shelter ended.  Dan Cathy’s sleeping over at The Pine was history.

As chair of the mayor’s commission, Sibley was operating as an agent of the City of Atlanta.  That’s called Tortious Interference.  Georgia State University School of Law gave an annual award to Sibley as the lawyer in Atlanta who did most for homeless people.  For his stopping money going to The Pine, he was deposed for six hours by Steve Hall, Baker Donelson attorney representing the Task Force.  Sister Jane Garety, a nun who works for the Denver based Mercy Housing, Inc., wrote an email to Horace saying that the City of Atlanta will be indebted to Mercy Housing, Inc. for its part in helping Emanuel Fialkow foreclose on the Peachtree Pine building.  How do you like them apples?  A Roman Catholic Nun-Run organization, whose mission is to help nonprofit organizations avoid foreclosure, winds up in bed with the likes of A. J. Robinson, Manny Fialkow and Horace Sibley.

Is it any wonder Horace Sibley’s name surfaces at the mention of TEAM GOLIATH, that hideous strength.  On the first day of Christmas, Horace Sibley sent to me a family living in a pear tree.  I wonder if that family would be labeled by Horace “chronically Homeless” or just the regular run of the mill homeless.

On the second day of Christmas, Mayor Kasim Reed sent to me two Innovation Delivery Team members.  NYC Mayor Michael Bloomberg in the summer of 2011awarded $1.4 million for each of three years to five cities.  Atlanta is one of the five.   The money was allocated to address homelessness in Atlanta.  Reed created his Innovation Delivery Team to address two specific areas:  panhandling and customer service in Atlanta City Hall.  This improved service was to be delivered primarily to the business community.  While both areas badly need attention, the homeless mother with an infant may have more pressing needs on a cold January night than panhandling and customer service in City Hall.

Superstar Kristin “Lexis-Nexis” Wilson according to the mayor handled millions of dollars and will be assisting the “chronically homeless.”  One the second day of Christmas, Mayor Reed sent to me two members of the $1.4 million Innovation Delivery Team.

On the third day of Christmas, Debi “homeless czar” Starnes sent to me, three bogus letters signed Greg Pridgeon.  During the Czar’s tenure of serving homeless people, She wrote three letters signed by Greg Pridgeon.  These letters were written to the state blocking all public funding to the people at Peachtree Pine.  Since the signing of these letters, no public money, city, county, state or federal has gone to support the people at Peachtree Pine.  The City’s Office of Grants Management approved funding all three years but Starnes and Franklin overrode that decision.  Greg Pridgeon, I understand, is today the manager of Rockdale County.  On the third day of Christmas, Debi Starnes sent to me, three bogus letters signed Greg Pridgeon.

On the fourth day of Christmas, Rector Hoare sent to me four fingers shooting the bird.  On Super Bowl Sunday 2010, Rector Hoare from his high pulpit at the Varsity Grill Episcopal Church blasted Peachtree Pine as a squalor, a place unfit for human habitation.  CEO Rector Hoare stands with the business community, coached by Central Atlanta Progress, damning the occupants and management of the Peachtree Pine Community.  I know that when government and business crawl in bed together the result is a form of fascism.  What’s it called when the church crawls under the covers with government and business.  I’ll ask Dietrich Bonhoeffer.  On the fourth day of Christmas Rector Hoare sent to me four fingers shooting the bird.

On the fifth day of Christmas, Emanuel “God with us” Fialkow’s lawyer sent to me five golden necklaces.  At one of the many hearings in the Superior Court of Fulton County, a dozen or so TEAM GOLIATH lawyers huddled.  One of these worthies representing Fialkow was bedecked in gold necklaces.  His wavy locks flowed down his back while his gold chains dangled down his front.  My mind took me to the New Testament, Acts 3:6 where Peter exclaims, “Silver and gold have I none, but such as I have, give I thee.”  TEAM GOLIATH boasts quite a roster with gold loving Hoare in his Episcopal pulpit and gold wearing barristers in the courtroom.  That’s a winner every time in our time.  On the fifth day of Christmas, Fialkow’s lawyer sent to me five golden necklaces.

On the sixth day of Christmas, Dave“Great news!” Wardell of Central Atlanta Progress fame and fortune sent to me six vats of Kool Ade.  On one of the three times that the City of Atlanta turned off the water at The Pine shelter, the head guy at Georgia State University Security read all about it in Atlanta’s only morning paper.  The security fellow was beside himself with glee, so he blackberried his pal David Wardell at CAP.  Wardell, in a meeting, blackberried back, “Great news!”  I wrote an entire blog citing how Wardell got his middle name.  What I was not able to ascertain was how Wardell became such a sensitive person.  Rather than letting them eat cake, let them drink Kool Ade, compliments of caring CAP.  In an earlier blog, the Kool Ade came from Mayor Franklin, Debi Starnes and dear Bruce Gunter.  Gunter recalling the Jim Jones massacre, said, “Debi, could I take a gallon to Anita Beaty?”  On the sixth day of Christmas, Dave“Great news!” Wardell sent to me six vats of Kool Ade.

On the seventh day of Christmas, A. J. ”We’re all kind of mystified” Robinson sent to me seven worms a squirming.  Robinson is the head honcho at the heartbeat of Atlanta, Central Atlanta Progress. He is the primary mover, along with the merciful nuns, in Manny “Do I smell a fault?” Fialkow scheme to swindle The Pine property.  His middle name comes from his quote in the morning paper when he learned of Debi Starnes’ yarn of a lice infestation at The Pine shelter.  Why dear A. J. exclaimed, “We are all kind of mystified.”  We were neve surer what mystified his mind; however, we never doubted it.  Was he mystified by the enormity of the Starnes fabrication or by the presence of a louse on his person.  The seven  worms a squirming symbolize the current trepidation of some of the good ole boys who have served so well TEAM GOLIATH, that hideous strength.  On the seventh day of Christmas, A. J. Robinson sent to me seven worms a squirming.

On the eight day of Christmas, Vince “Of model Gateway Shelter” Smith sent to me eight maids all nursing.  Under oath in three separate depositions, CAP”S Richard Orr and A. J. Robinson and the City’s Debi Starnes and Horace Sibley stated that The Gateway Shelter is a model and will be an arm in ending homelessness in Atlanta.  From time to time staff members at The Gateway send homeless women with their children, usually on foot, across town to The Pine.  Sometimes these women with their children have been refused entrance for any number of reasons.  Members of my staff have been told by The Gateway people that Peachtree Pine is no longer in operation.  One time we called and a woman working the telephone said she did not have a telephone number for Peachtree Pine.  So much for the Starnes/Sibley model shelter.  On the eight day of Christmas, Vince Smith sent to me, eight maids all nursing.

On the ninth day of Christmas, Protip “lights the way at United Way” Biswas sent to me nine mothers weeping.  The mayor’s commission on homelessness has metamorphosed from a potential state authority into a limp member now labeled United Way’s Regional Commission on Homelessness.  It does what the HAG (Starnes’ Homeless Action Group) does.  It does what Woody Bartlett’s HAP (Home Action Plan) did for a brief shining moment.  It does what Alan Harris’s group does.  They all do the same thing.  They all meet.  They meet. They meet.  They meet.  Protip is now the executive director of United Way’s Regional Commission on Homelessness.  I have no idea what “region” they encompass.  Early morning no long ago I encountered a mother with two children sitting on steps inside our building.  She was crying with her children sitting quietly beside her.  Someone at the Edgewood Ave offices of Atlanta United Way told her directions to Peachtree Pine.  This poor woman thought she might get help at United Way.  On the ninth day of Christmas, Protip Biswas sent to me nine mothers weeping.  Again, I have to ask Protip and his fellow experts, are these three people “chronically homeless,” or are they just your ordinary run of the mill homeless citizens of Atlant?  And which group are we serving this year?  Is 311 the way I reach Lexis-Nexis?

On the tenth day of Christmas, Jack Hardin sent to me ten Lords a quaking.  Lords quake and worms squirm whenever exposed to the light.  TEAM GOLIATH  boasts in its membership both Lords and worms and some of them are one and the same.  Three lawsuits are currently on appeal and all three involve movers and shakers, worms and quakers.  On the tenth day of Christmas, Jack Hardin sent to me ten Lords a quaking.

On the eleventh day of Christmas, Ratchet Rob “Happy to turn off your water” Hunter sent to me eleven huge rain barrels.  The garden atop the many thousand square foot roof contains thirty beds of vegetables.  Two rain barrels help water the hundreds of plants.  On command from Debi Starnes, Ratchet Rob three times turned off the water used for cooking, bathing, flushing and drinking.  Ratchet Rob Hunter lost his job as Commissioner of the Department of Water Mismanagement at the City of Atlanta.  Word has it that he turned off the water of one too many Buckhead Betty.  On the eleventh day of Christmas, Ratchet Rob Hunter sent to me eleven rain barrels.

On the twelfth day of Christmas, Renee Glover sent to me twelve leveled housing communities.  Renee Glover heads the Atlanta Housing Authority, and she lounges in the fact that she is one of the darlings of Washington HUD.  Although she’s been scorched around Atlanta for a few little money improprieties, she’s evidently safe in the arms of Jesus.  I don’t know how a few million dollars in the wrong place here and there could cause a problem, surely not in Atlanta.  The United State’s public housing policy for the last 25 years is perfectly mirrored in Atlanta, in the Atlanta Housing Authority.  Since 2005 in Atlanta, 3200 units of public housing have been demolished, leveled, removed, disappeared.  In those units 9,600 men, women and children have been displaced and not placed anywhere.  The federal government’s policy on housing the poorest of the poor is to actively disappear them.  How do I know this?  I know it through my staff members who speak with some of these victims every day.  Atlanta Housing Authority has disappeared the poorest of its poor residents.

Demolishing run-down, drug-infested, rat infested units of housing and replacing them with safe sanitary living quarters is commendable.  Displacing 9,600 people from 3,200 units of housing with no intention of rebuilding them is detestable.  The City of Atlanta gets up early and stays up late working on disappearing low-incoming housing and no-income housing.  Disappear both out of sight.  (Micah 2:1-2:TEAM GOLIATH’S favorite Hebrew Bible passage).  These two example of disappearing the poor from our streets and the poor from their houses exposes to full light where we are as a City and where we are as a nation in addressing the least of these among us.

My pieces NIGHT BEFORE CHRISTMAS and AN EXPLANATION OF THE TWELVE DAYS OF CHRISTMAS touch many of the people within the hideous strength that I have named TEAM GOLIATH; however, I have not scratched the surface of suffering humanity my staff deals with 24 hours a day.  And those suffering ones are the very ones that the TEAM GOLIATHS crush beneath their boots every day.  It does not have to be this way.  Atlanta does not have to be this way.  City Council does not have to be a nest of simpering pawns.  City Hall does not have to be a den of corrupt climbers, 1.4 million dollars for salaries and customer service while babies and children are languishing before our very eyes.

The last verse of the fourth gospel come to mind; John21:25 says, “And there are many other things that Jesus did, the which, if they should be written every one, I suppose that even the world itself could not contain the books that should be written.  Let me borrow from John’s metaphor.  Let us stop piling atrocities upon atrocities that are filling more than all the books of the world, and let us begin doing for each other what the Galilean told us to do.

Jeremiah 22:16

January 8, 2013

In an attempt to defend the City of Atlanta against charges of tortuous interference, collusion, corruption, racketeering, false claims, violations of protected classes’ civil rights and sundry other crimes, city lawyers on Thursday, April 7, deposed Pete Walker, former head of Mercy Housing, Inc. Southeast. One of the many mountains the City must climb is to dissociate itself from some of its fellow conspirators. The City wants to distance itself from Mercy Housing, Inc. who sold $900,000 worth of notes to Ichthus, Inc. the highly suspect “company” creation by the deeply-tainted Atlanta developer, Manny”Do you smell a fault?” Fialkow.

Mercy Housing, Inc. and its twin sister Mercy Loan, Inc. chose to receive $700,000 to $900,000 from Ichthus, Inc. rather than from Central Atlanta Progress. For some reason the nun-run Mercy must have believed that the Las Vegas created, “Christian” Ichthus, Inc. was the less of the two evils. How Manny “Do you smell a fault?” Fialkow could have dirtied the nuns’ linens less than A. J. Robinson’s CAP, no one knows.

And no one on the little David side knows the exact amount of $$$ the nuns received, thus my stating above “$700,000 to $900,000.” And another question asks did the nearly one million dollar payment come from Manny Fialkow personally or did that money come from the deep pockets along Peachtree, those honorable business interests that form the corridor from the gold dome to the coffers of Buckhead. Cousins Properties, Inc. comes to mind. Hallowed Coca Cola comes to mind. Emory Health Care, Inc. lifts its head. Notes on somebody’s pad at Mercy wrote that one million was available in a day.

Pete Walker no longer works for the nuns. He is currently the top man at DeKalb Housing Authority. I believe that the City of Atlanta wants to remove itself from the fraudulently taking of the Peachtree-Pine Building. And to do this the City brought in a thoroughly coached Walker who appears in e-mails from the key conspirators, A. J. Robinson, Horace Sibley and Debi Starnes.

Baker Donelson Attorneys Steve Hall and Bob Brazier prohibit my writing about a deposition before that deposition has been “made public.” There are many valid reasons for this prohibition, and I honor the reasons and these capable attorneys.

On the other hand, when the Baker Donelson attorneys receive the documents after they have been filed, I am free to “write them across the sky.” For example, I know what Pete Walker said April 7, 2011, UNDER OATH, but I cannot speak of it or write about it. I have to wait until I get that green light. The pitch count so often against these court jesters is three balls, no strikes. I cannot swing for the fences until I’m given the green light by my third base coach, Attorney Steve Hall. Then the fences move in like MacBeth’s Birnam wood. TEAM GOLIATH’s tasteless atrocities bring in the fences.

I cannot quote Walker yet; however, I have two full depositions with Debi “not on top” Starnes’ answers. Read the following lines to determine if The City was joined at the hip to the nuns.
The questions and answers are lifted from Debi “not on top” Starnes’ deposition taken on September 2, 2009. Steve Halls’ questions begin on page 166, line 18.

Hall: So your recollection of the events is that you went and saw Pete Walker. He’d gone so far as to have a mockup or a drawing of the building, a picture of the building that he wanted to build.

Starnes: Uh-huh.

Hall: And then you thought it was a great project.

Starnes: Uh-huh.

Hall: And then you went back, and when you heard about it from Ms. Glover in this e-mail, you said that basically the City and the Atlanta Housing Authority need to leverage Mercy into this by saying that the project does not go forward if the shelter stays. True or false?

Starnes: I don’t know what you mean “leverage Mercy into this.”

Hall: It’s your word.

Starnes: No: but – – no, you just – – you made up a whole new sentence.

Hall: “I believe Mercy needs the leverage of the City and AHA saying, No, if the shelter stays.”

Starnes: Right.

Hall: Okay. So you had seen the project, you liked the project; but you did not – – you were not going to allow – – you were going to get the City and AHA to say no to the project if the shelter stayed.

Starnes: That’s not my memory, no.

Hall: That’s what you wanted to happen.

Starnes: No. My advice, which I have said to you multiple times, is that nobody, Mercy or no one, would be successful at putting housing on top of hundreds of people in a mismanaged shelter.

Hall: Do you know – –

Starnes: I wouldn’t advise anyone to put housing on top of Gateway either. It’s an odd concept.

Hall: Is that because Gateway is mismanaged?

Starnes: No. It’s too many people in one location.

Hall: Okay. So you wouldn’t put it on top of any shelter.

Starnes: Of that many people, no.

Hall: Are you aware of other cities that are doing it? Seattle?

Starnes: No.

Hall: You’re a Ph.D. in these types of studies. You’re not aware of any other cities doing this?

Starnes: No.

Hall: What did you do to research how this type of proposal had worked in other cities before suggesting that the – –

Starnes: No research.

Hall: – – City and Atlanta should leverage our partner, the Task Force partner, into not doing something? You didn’t do anything?

Starnes: (Shakes head negatively)

The tight connection between the City of Atlanta and Mercy is exposed by its relationship with individuals throughout the conspiracy. Sister Jane Gerety in an e-mail to Diane Leavesley, then the top dog of Mercy Loan, Inc. states that Horace Sibley assured Gerety that the City and downtown Atlanta would be in huge debt to their organizations if Mercy put the Task Force in defauld. Sister Gerety wrote in another memo that having spoken with people in “the city” she had decided to pull the plug on negotiations between Mercy and The Pine. Lawyers on both sides have stacks of emails that have Mercy and the Ciy and A. J. Robinson all talking. The Ms. Glover in Starnes’ e-mail is the indomitable Renee Glover of the Atlanta Housing Authority. She’s HUD’s darling for having successfully rid Atlanta of those poorest of the poor who have been thrown out of public housing. What she has done is commendable, lovely housing for a few. What she and HUD have not done is damnable, blocked housing for the poorest of the poor. She promised NOT ON TOP to help block housing at The PINE. The plot thickens.

Note: The depositions of Shirley Franklin, CAP’s Dave Wardell, City’s Greg Pridgeon and Pete Walker have not been given me. Stay tuned. A reader from California told me that he searches Atlanta media daily for info on the lawsuits, to no avail. He understand; he lived in Atlanta.

Before his quietus Manny “Micah 2.1-2” Fialkow may have many middle names. He may earn a prefix, “Many names” Manny. I learned some of his questionable business practices reading the deposition of his buddy A. J. “We are all kind of mystified” Robinson. Their dirty dealings and under the table practices with the nun-run Mercy Housing, Inc. bring to mind Micah 2.1-2. Those verses from the Hebrew Bible, familiar I am sure to both Manny and A. J., read, “How terrible it will be for you who lie awake at night, thinking up evil plans. You rise at dawn and hurry to carry out any of the wicked schemes you have power to accomplish. When you want a piece of land, you find a way to seize it. When you want someone’s house, you take it by fraud and violence. No one’s family or inheritance is safe with you around. (New Living Translation)

Months ago in open court I heard the Honorable Judge Craig Schwall, Sr., say to Manny Fialkow’s lawyer that Mr. Fialkow’s business behavior “does not smell good.” That day, sitting respectfully in the court room, I racked my brain trying to recall Shakespeare’s use of the word “smell.” Months have passed since the cobwebs in my brain blocked my ability to recall.

Today, this happy February 25 day in the 2011th year of our Lord, I stumbled across what was hidden in my brain. There it is. It sits before me. There is Manny “Micah 2.1-2” Fialkow’s new middle name. The brilliant manager of programs at Central Atlanta Project has two middle names. He is Richard “We’re in!” Orr and Richard “Crap sniffer” Orr. We do not want to neglect the philanthropic giant, Manny Fialkow, who has given back so much to the community. “Many names” Manny deserves so many names. For now we have found his second middle name.

In Act I, Scene 1 of KING LEAR the Earl of Kent asks about the comely lad at the side of the Earl of Gloucester.
Kent. Is not this your son, my lord?
Gloucester. His breeding, sir, hath been at my charge. I have so often blushed to acknowledge him that now I am brazed to it.
Kent. I cannot conceive you.
Gloucester. Sir, this young fellow’s mother could, whereupon she grew round-wombed and had indeed, sir, a son for her cradle ere she had a husband for her bed. Do you smell a fault?

Ah, there it is. That’s the spot. That’s the quote I wanted when I heard His Honor say in the Superior Court of Fulton County that something did not smell good. Speaking of not smelling good, Rector Hoare in his Super Bowl sermon, February 6, entitled “Doing Justice” has wrinkled a few noses that even the Rector himself may not have wished to have wrinkled. I hear that a few Episcopalian noses, already elevated, may have a new wrinkle or two.

Rector Hoare mentioned the “new owner” of Peachtree Pine. Manny “Do you smell a fault?” Fialkow is the alleged owner of the building called Peachtree Pine; he may be A. J. Robinson’s shill. That’s a tossup. The nuns were paid some $700,000 so that the “highly respected” Mercy Housing, Inc. would not be on national news putting 600 homeless people on the streets in Atlanta. The nuns know Central Atlanta Progress. These essentially corporate minded nuns wanted out, and they got out acknowledging that the City of Atlanta owed them big. Developer Manny may have used his own money. He may have not. He may have gotten it from his buddies. Atlanta has a buddy system that boggles the honest mind. $700,000 for this conspirata is pocket change.

We know that Uplift Atlanta, Inc. a hazy non-profit, shepherded perhaps by the spirit led Christian clerics along the cleansed corridor, has millions of $$$ ready to help homeless people out of sight whenever Airlift Atlanta can get their hands on the “treatment-resistemt” Black men at Peachtree Pine. Their reverend representative said so much in open court to Judge Schwall. That is how Rector Hoare can spew his undocumented, untrue drivel about evicting the management at Peachtree Pine but at the same time keeping the 600 “treatment-resistant” Black men at Peachtree Pine.

I wonder if Rector Hoare has checked with Peggy “arrest the bums” Denby’s NPU-M about keeping 600 Black men in her neighborhood. I will tell you in private what “M” stands for in the minds of those gallant 600 Black gentlemen at Peachtree Pine.

Manny Fialkow has a new middle name. Being the intellect that he is, I know that he will be honored to learn that it comes from Shakespeare’s KING LEAR. That is W-I-L-L-I-A-M S-H-A-K-E-S-P-E-A-R-E and that is a play that the bard called K-I-N-G L-E-A-R.

Gloucester said to Kent, “She had a son for her cradle ere she had a husband for her bed.”
Jim Beaty says to TEAM GOLIATH, “Fialkow had a scheme for his swindle ere he had a sentry for his scheme.”

The Earl of Gloucester and Manny “Do you smell a fault” Fialkow have many things in common. They touch. They are both Earls. They are both of the nobility. They both have questionable morals. They both run in the best circles. They both have the protection of the clerics that surround them. They both emit a smell that indicates a fault. They both win for a season.

I must say goodnight to my readers. Goodnight to the 600 “treatment-resistant” Black men at The Pine. Goodnight, Judy. Goodnight, Jim Lee Scott. Goodnight, Gary. Goodnight, Larry. Goodnight, Hepsy. Goodnight, Rick. Goodnight, Lattimore. Goodnight, Valerie. Goodnight, Antoine. Goodnight, William Heard. Goodnight Darrell. Goodnight, Paul. Goodnight, Gateway. Goodnight, Horace Sibley. How you ever sleep baffles me. Goodnight, Ko. Your emails make for hilarious reading, but they do distress my nether regions. Goodnight, Biswax. I cannot wait for your deposition. Goodnight UW president, Milton Little. I praise God that Jack Hardin saw fit to give you your $500,000 a year job. How much is that a month? I know you earn it, every dime. Will you bring Hardin to your deposition? Goodnight Lawyer Ruth, Shirley Franklin’s attorney. I pray to my creator that I can behold your grandeur before I go home. I understand you are a piece of work. Goodnight, Debi Starnes. Your silence knocks me out. Who shut your mouth? Why is AJC sometime reporter Rhonda Cook not taking dictation from you? Has our astute Mayor missed your brilliance? Goodnight, Manny “Do you smell a fault?” Fialkow. Your quietus, here or in the hereafter, looms. I may not see it here; I’ll bet you a quality jug of sour mash that I’ll watch it in the hereafter. Goodnight, Earl and Hilda and all the others who left The Pine to become employees at Gateway or the other Way. Goodnight, my little ones. Good night, love of my life.

Many of the residents at the Peachtree Pine Community have proven to be computer people. Brilliant computer volunteers come in and teach classes, two each week on Tuesday and Thursday nights. Many of our residents attend churches and synagogues along Peachtree Street, the “sanitized corridor.” Of course they attend these houses of God disguised. They do this in order to worship without being harrassed, perhaps removed.

A reader of PEACHTREE corridor sermons called distressed. The caller told me that an Episcopal priest just off Peachtree Street on February 6, SUPER BOWL Sunday, blasted our home, Peachtree Pine. He said that this “preacher” is one of those determined to close down our community. I said, “That can’t be. You are mistaken.” Then I asked the name of the church and the name of that particular man of God. He told me both. I said, “I beg your pardon. You are surely right.” I told my man that the particular priest he mentioned is the finest of all Episcopal priests in our area. My man asked me on what basis did I make my assessment.

I told my man that the sermon he read blasting everything at The Pine was delivered by the highest paid priest in the Episcopal Diocese. He takes more dollars home than our Bishop, the Holy Neill Alexander. I am an Episcopalian, and I know how we rate what is fine. In our places where we worship, you get what you pay for. Money talks. My man asked me if the churches and synagogues along Peachtree hated homeless people as much as the City and Central Atlanta Progress. I sang for him Cynthia Clawson’s beautiful song, “It Won’t Rain Always.”

Someone said that in each life some rain is bound to fall,
And each one sheds his share of tears and trouble,
Troubles are solved.
But the hurt can’t hurt forever, and the tears are sure to dry;
And it won’t rain always.

The clouds will soon be gone;
The sun that they’ve been hiding
Has been there all along.
And it won’t rain always; God’s promises are true,
The sun’s gonna shine in his good time,
And he’s gonna see you through.
The sun’s gonna shine in God’s own good time,
And he will see you through.

My man and I agreed that the members of TEAM GOLIATH reach high and low. Manny Fialkow is a well-known developer of questionable ethics. For him to have been chosen as Central Atlanta Progress’s tool surprises no one, not even Nun Sister Jane Garety of Mercy Housing, Inc. For a dirt digging “news” relic like Richard Belcher to air “news” that’s old is fully expected. I for one have wondered where TWO has been. A station who airs Bortz surely sucks up to City Hall and that crowd. I believe their slogan is, “When news breaks out, we break out.” Or something like that. If WSB ever reports the news, I’ll break out.

Are you surprised that the highest paid Episcopal priest in Atlanta from his pulpit would take sides with Manny Fialkow and Central Atlanta Progress and City Hall and the Chamber Pot and United Way and Uplift Atlanta (Airlift Atlanta) against 660 African American males LIVING on hallowed Peachtree Street? If that shocks you, let me introduce you to the Third Canto of Dante’s INFERNO. Let me remind you that for every ONE true prophet in Elijah’s day there were 400 false ones. Remember, it won’t rain always, AND God’s burning rain may very well be on the way.

Developer Manny Fialkow and “Investigative” Reporter Richard Belcher rush rapidly on the course of their destination. They move rapidly to where they are headed. Do not be so stupid to be shocked that an Episcopal priest follows hard behind. These worthies know only success. They are successful. Their reward is with them. The title of this piece confuses even the writer; on some days the very high and the very low are not easily distinguishable. They are Siamese twins.

On November 12, 2008, Sister Jane Gerety of Mercy Housing Fund, Inc. wrote to Julie Gould, a colleague, “I wanted to talk to you about the possibility of the foreclosure on the Peachtree and Pine property in Atlanta. I’ve talked with Pete (Walker) and with others representing the city and believe that foreclosure is what we should do. . . . Moving the men is very doable and represents a philosophy that I think is much more enlightened than warehousing them in the present philosophy. In addition if Mercy Housing can help to accomplish this, I believe we will be in the debt of the city, the business community and the foundations. Horace Sibley who chairs the Mayor’s Commission to End Homelessness told me that if we can get this accomplished, we should pass the hat immediately.”

I, Jim Beaty, write this piece from a Tuesday night computer class held at the Peachtree Pine Community. Ten residents are taking this class in the refurbished, fully furnished computer lab. Another class meets on Thursday nights and the term runs through February. I’m enrolled in the class as a computer illiterate. I wish Jane Gerety and Julie Gould and Diane Leavesley and Pete Walker and Horace Sibley could see the ten members of this happy family rejoicing as they send each other emails for the very first time. Antoine Moseley, soon to graduate from the Transitional Program emailed me his words entitled, I Was NOT Warehoused At Peachtree-Pine.

Six hundred residents will sleep in the warm confines of Peachtree Pine tonight; the low tonight in downtown Atlanta will be 21 degrees. Get the picture, the largest facility in Georgia that houses men who have absolutely nowhere else to go is the target of Atlanta’s political leadership and corporate muscle. While forty or so churches minister regularly to the community at Peachtree Pine, the churches and synagogues from the state capitol to James Dickey’s Buckhead have avoided the plague of Peachtree Pine. Their silent consent clearly concurs with the vehement voice of the Chamber and the downtown conspirators. And Mercy Housing paved the way to foreclosure by a slum lord, bottom-feeding developer, Manny Fialkow.
One exception along the sanitized corridor is The Cathedral of Saint Philip, the largest Episcopal congregation in America. For 22 years this cathedral has held a Requiem Mass remembering the homeless dead of Atlanta. Dozens of members of that congregation come monthly to feed, clothe and interact with the residents. That being said, the Outreach Committee of that Cathedral funded the Task Force ZERO dollars this fiscal year. The amount per year for the previous years was $30,000. Horace Sibley and others got to that committee. This sorry state of tortuous interference just beneath the Dean’s nose can change in the telling light of subpoenas and depositions and lawsuits.

The chair of the committee that stopped the funding said under oath that her thinking on the decision to not fund would have been altered had she known the contents of the documents presented by Task Force lawyers. The documents from Sibley’s deposition put him in the middle of God’s business there in Buckhead’s Jesus junction. Sibley acted on behalf of the city and Mayor Shirley.

On December 8 Catholics celebrate The Feast of the Immaculate Conception. Unknowing Protestants don’t realize that the “conception” herein referenced is not the conception of Jesus that took place in Mary. This conception takes place without sexual activity in the body of Anne, Mary’s mother. As the holy season approaches I’m confident that Mary’s words in the Magnificat permeate the hearts of the Mercy Housing Inc. conspirators, “He hath put down the mighty from their seats, And exalted them of low degree. He hath filled the hungry with good things: And the rich he hath sent away empty.” Luke 1.52,53

The following blog consists of excerpts from documents given the Atlanta Task Force Board of Directors by Baker Donelson Attorney Steve Hall. This Civil Action has been filed within the last fortnight with Judge Craig L. Schwall, Sr., Judge, Superior Court of Fulton County.

METRO ATLANTA TASK FORCE FOR THE HOMELESS, INC. and ANITA BEATY, Plaintiffs
v.
EMANUEL FIALKOW; THE BENEVOLENT COMMUNITY INVESTMENT COMPANY, INC.; CENTRAL ATLANTA PROGRESS, and THE ATLANTA DOWNTOWN IMPROVEMENT DISTRICT, Defendants

Written Discovery:
“Plaintiffs have multiple depositions and thousands of documents that they have offered to make available Defendants (and Ichthus) at a mutual convenient time and location. CAP, ADID and BCIC have not served any discovery. In addition, while Plaintiffs anticipate discovery disputes (Ichthus has refused to provide electronic discovery), Plaintiffs plan on addressing these issues with the Special Master.
“Unfortunately, for reasons it has not disclosed, Ichthus has refused to consent to these depositions being taken jointly in all cases. This places a significant burden on the witnesses and parties.

Motion to Pursue Dispossessory
“At the initial hearing the parties hearing the parties pursued cross-motions for TRO, with Ichthus seeking to evict the Task Force and Anita Beaty from the Shelter (among other things) and the Task Force seeking to prohibit any actions to interfere with their use of the Shelter (among other things). At the conclusion of the hearing, the Court entered an order allowing the Task Force to remain in the Shelter, consolidating the dispossessory actions that were filed by Ichthus separately in the State Court Action, and forming a committee to review the conditions at the Shelter. Plaintiffs believe that the situation even more strongly favors maintenance of the status quo today than it did at the initial hearing. Specifically, Plaintiffs note: (1) the weather is getting much colder and the services they provide to the homeless are even more needed this time of the year; (2) the Committee Report has dispelled Ichthus’ false assertions about the conditions at the Shelter; and (3) Plaintiff’s discovery has uncovered significant additional evidence demonstrating the conspiracy to harm the Task Force and specifically showing that the improper actions of Defendants caused Plaintiff’s lenders to sell the Notes at issue. Attached hereto as Exhibit “A” are a few examples of this evidence, including an email from an influential representative of Task Force’s lenders showing that they were convinced to foreclose or sell the Task Force’s Notes by communications from the City and Defendants falsely stating that the Task Force was not helping the men in the Shelter, an email showing Fialkow congratulating Central Atlanta Progress on the very type of anti-homeless discrimination efforts that are at the heart of this case and notes from communications with A. J. Robinson referring to his plan to use business interests (such as Ichthus) to carry out the plan to acquire the Notes. Accordingly, Plaintiffs believe this Motion should be summarily denied or stayed.

The following notes and e-mails are quoted from Exhibit “A”:

Julie,
I got your voice mail. Thanks. I wanted to talk to you about the possibility of foreclosure on the Peachtree and Pine property in Atlanta. I’ve talked with Pete and with others representing the city and believe that foreclosing is what we should do. It needs to be part of a plan to move the men living in the shelter to other facilities where there are supportive services and a proposal from Mercy Housing for affordable housing on the site. There may be some negative publicity, but I think that can be mitigated by the plan and the proposal. Moving the men is very doable and represents a philosophy that I think is much more enlightened than warehousing them in the present facility. In addition, If Mercy Housing can help to accomplish this, I believe e will be in the debt of the city, the business community and the foundations. Horace Sibley, who chairs the mayor’s commission to end homelessness, told me that if we can get this accomplished, we should pass the hat immediately.

Note: The typed portion of this e-mail ends here. The following “paragraph” contains handwritten notes that read as follows”

“Anita’s vision meets people. Horace wants to get people out of homelessness. 1 by 1 her funding sources have dried up. A proposal to rehab the bldg to maintain the shelter w/sro hsg above. Foreclosure – sensitively & delicately. Horace has a plan to move the men.

Thank you Sr. Jane for sharing these important views! I’m copying Diane Leavesley, the president of the Mercy Loan Fund who is one of the participants on the loan with another nonprofit (we do not own a controlling interest ). I’d suggest we get on the phone if she is able to this morning Denver time. I’ll be here until 12 noon ET. In case we miss Diane’s direct number is 303 – 830 – 3469. I know that she and her partner are working through all the options and are very sensitive to the homeless and the community in doing so. All the best, Julie.

Note: The most devastating lie that TEAM GOLIATH could tell is that The Pine does nothing but “warehouse” the people who stay there. That TEAM has broadcast that lie for ten tears across Atlanta. In 2008 that falsehood was told to nuns et al who bought it hook, line and sinker.
Be sure to read my blog entitled, “I was NOT ‘warehoused’ at Peachtree and Pine” Maurice Lattimore

Every page of discovery, e-mails, letters, depositions, some 3000 in my possession points to racketeering activity (RICO) on the part of Central Atlanta Progress, Debi Starnes and many other individuals and organizations known around Atlanta as TEAM GOLIATH. A paper trail miles long shows that since Starnes’ election to Atlanta City Council in the early nineties, she has labored tirelessly to defame the Atlanta Task Force, Inc. and to disappear homeless people from anywhere near downtown Atlanta. Her raison d’etre, outside her personal gain, has been to fulfill the desires of those she serves. A tool accomplishes a task. Debi Starnes is a tool of the powers who own her. And her owners have demanded the annihilation of the Task Force and the disappearance of homeless people.

I do not know the day that Starnes and A. J. Robinson joined at the hip. I know it happened long ago; “ongoing” is the term in the law known as the RICO Act. The years now show that Starnes’ meshing with Robinson and CAP put her in bed also with ADID, United Way, The Chamber, the Mayor’s Commision, the nun-run Mercy Housing and more recently Emory Healthcare, Inc. and Cousins Properties, Inc. Starnes latest badge of honor boasts her bond with bottommost Emanuel Fialkow. These birds of a feather have flocked together to form a textbook cabal that has defamed, stolen and taken. And they have manipulated it all in the name of serving homeless people in Atlanta. The are what Roman Catholic Father Daniel Berrigan calls the “doers of all good.”

Debi Starnes’ creation, The HAG, is a young adult by now. Its bastard offspring, HAP (Homeless Action Plan), would be a teenager today had the poor malformed wad survived. Word around CAP has it that HAP died before Woody Bartlett could administer Episcopalian last rites. Others say it perished in the womb for lack of interest. HAP had many siblings, mercifully all gone home: there was Odyssey III and Circumlocution IV and the ROC and the SOC. They are all buried or should have been. Oh, don’t forget the multimillion dollar Gateway, the shelter Richard Orr believes will end homelessness. City-blessed programs cannot help homeless people because they are not designed to do that. Homeless people flee the HAG.

A. J. Robinson, a tool of greater powers and Debi Starnes, a tool of the tool, show up on every other page of discovery in the law suits: the Civil suit in Federal Court against the City of Atlanta, the Countersuit against five (seven if you count Fialkow and Robinson twice) and the Housing Discrimination Complaint filed with Washington HUD on May 6, 2010.

Both Starnes and Robinson have been deposed by Baker Donelson, Atlanta Attorney Steve Hall. Each deposition lasted in excess of 5 hours and each faces another deposition, as does CAP’s Richard Orr.

Wading through the excrement on the thousands of pages of discovery, I take note of especally telling e-mails or memos or letters by these various Conspirators. One jewel that shines through a glass darkly is an epistle to The Honorable Lisa Borders, President of Atlanta City Council, from A. J. Robinson. The letter is dated August 7, 2007.

Robinson’s first sentence reads, “I want to share my experience and the reactions of many more of our constituents who sat through an eight-hour Community Development Committee meeting last week.

The meeting was held in City Hall Chamber to discuss the Mayor’s letter cutting $100,000 from the Task Force budget that had already been fully approved by the City’s Department of Grants Management. Starnes had circumvented the approval with a letter to the State killing the possibility of funding. A righteous vote by City Council could have reinstated the $100,000. Robinson, his flunkies and many of his “constituents” were in attendance.

The second sentence of Robinson’s letter reads that “the Peachtree-Pine shelter did not meet the test to deserve public funding.” Keep in mind the City’s Grants Management Office had long before granted full approval. Starnes’ tortious interference stopped the $100,000.

Robinson’s next paragraph addresses the “lack of decorum” of the meeting.

The third paragraph shines, showing that CAP and ADID are not insensitive, callous suits. Like normal people they get their feelings hurt. Please read Robinson’s paragraph, “For years, representatives of our membership and neighborhood groups have come to meetings and sat quietly for long hours to speak on issues, only to be verbally attacked, called recists, slave owners and much worse by contingents of the homeless community, former City Council members, and Anity Beaty and Company.”

I believe Mr. Robinson is saying how dare those dregs like “former City Council members” come in here and call CAP and ADID and “our Constituents” names. Why, what is this world coming to? What will they say at the Commerce Club? “Wake up, Atlanta! Stay up, Atlanta!

The rhetoric of the letter gets better. He’s troubled that “the dignity and democracy of council proceedings has (sic) been allowed to deteriorate into a three-ring shouting match peppered by racial epithets.” Amazing, O Great Jove! A. J. Robinson wants “democracy” in proceedings! Democracy in proceedings!? The man who had Richard Orr rig a Tri-J Continuum of Care meeting with his “constituents.” He and Orr were gleeful when they succeeded in cutting “Anita’s funding. Dignity and democracy!

His nexr paragraph exposes his presence, eight hours of his presence. “Just as sad are the many hours of time (Council members, staff) that were expended on the discussion over a $100,000 grant. As a taxpayer, it doesn’t send a good signal as to the efficiency of the process.”

Robinson cannot understand how in blazes it could take 8 hours to steal a grant of $100,000. That should be accomplished over a cup of coffee.

He closes the letter to Borders with a genuine thrust, a great truth. He writes, “There will always be legitimate disagreement in matters of policy as to the City’s governance. Conversely, there should always be a setting where all sides have equal hearing and are free from verbal attack.”

A. J Robinson wrote that he wants a setting, “where ALL SIDES HAVE EQUAL HEARING AND ARE FREE FROM VERBAL ATTACK.” (capital letters mine)

We see the soul of this child of God. He wants no criticism when it comes his way; however, the rigged meeting of the Tri-J funding group had not one voice speaking for the Task Force. So much for dignity, democracy equal hearing for all sides.

Is there a Cousins Properties connection to the TEAM GOLIATH Central Atlanta Progress/ADID conspiracy to seize the Peachtree Pine property?  The minutes of the Executive Committee of Central Atlanta Progress, Inc. and Board of Directors of Capacity, Inc. may answer that question in the words of Tom Bell, a power in both those houses, Cousins and CAP.

The minutes of the November 12, 2008, meeting in CAP”s offices read as follows under the heading: Peachtree-Pine Shelter update – “Robinson reported on several issues related to the financial viability of the Task Force for the Homeless and their possible default on more than $800,000 in loans from Mercy Housing.  TOM BELL SUGGESTED THAT IT MIGHT BE POSSIBLE FOR THE LOANS TO BE PURCHASED FROM MERCY.  More information will be available in the future, as there are plans for internal staff movements at Mercy Housing that could be more favorable to the community’s efforts.”

Note:  The capital letters are mine.  These minutes were penned by Secretary Paul Kellman who turned prophet when he wrote, “More information will be available in the futire….”  Indeed, about 4000 pages of information subpoenaed from CAP, ADID and the third defendant, the City of Atlanta have come available.  Out of the mouths of babes….
