When City of Atlanta attorneys deposed me in February of 2010, I answered their questions for 5 hours. They focused exclusively on what I had written. Lawyers at the city had read every essay. When the weak “Beacon” in NPU – M responds with comments on my blog spelling ICHTHUS, “Ithcus,” I know that the well-oiled hate machine of Peggy “Arrest the bums” Denby is reading my essays. In fact many members of the love to hate TEAM GOLIATH read this blog. I hope this Table of Contents helps Richard Orr find his several middle names. God bless you all as you read the truth.

On Thursday, December 9, 2010, Judge Craig L. Schwall, Sr. denied a motion filed by ICHTHUS Community Trust, Co. (Manny Fialkow) to remove Anita Beaty and The Metro Atlanta Task Force for the Homeless, Inc. from the Peachtree-Pine Community. A handful of us from Team David go to these hearings praying for relief from the heel of the oppressors. Several of us arrived early, some 30 minutes before the 2:30 hearing.

Courthouses frighten me in general. What I saw representing the best of two worlds terrified me in particular. And there before my wondering eyes should appear two giants from two different worlds, the spiritual and the corporate, the holy and the not so. Heavenly power, earthly power. Two forces I would not expect to be huddled in deep conversation against the wall outside a Judges’ courtroom. I’m learning from every suffocating moment to suffocating moment that the church world and the developer’s world are not far apart.

I was told by a colleague that the collared clergy is the Reverend Dan Matthews, the Rector of St. Luke’s Episcopal Church, a centerfielder’s peg from Peachtree-Pine. Residents of The Pine standing with me identified the gentleman standing with the man of God. They knew him as the person who interviewed for tenants at Crossroads also across The Pine. They said he offers slum dwellings. The second deep in conversation with the man of the cloth is Manny Fialkow, they told me.

Can it be? We learn from history and movies and the Hebrew Bible that conspiracies make for strange bedfellows. The huddle outside the courtroom continued inside. Five TEAM GOLIATH attorneys sat around the room. I thought I was watching THE GODFATHER: lawyers and priests and court reporters and bailiffs and a few of us homeless folks longing for a piece of the justce pie.

The conspiracy that I’ve named TEAM GOLIATH truly has brought together strange bedfellows. And those confluences are not UPLIFTING.

Testifying before Judge Craig Schwall in Superior Court of Fulton County on December 9, 2010, the Rev. Darrell Elligan, told the Court that a new organization, Uplift Atlanta is prepared to pay Manny Fialkow’s ICHTHUS Community Trust, Inc. $39,000 rent per month for the Peachtree Pine building presently occupied by The Metro Atlanta Task Force for the Homeless, Inc. and 700 residents who call it home. The Rev. Elligan added that the $39,000 per month would be paid for only 3 to 6 months.

Questions loom. Would a group willing to put $39,000 in Manny Fialkow’s pocket be happy to pay patient Georgia Power the overdue electric bill, $35,000? Would good Uplift Inc. pay the gas bill for The Pine so that people who have taken cold showers for 18 months could have a little warm water? For Christmas, perhaps? Could Task Force employees not paid for two full years get a month’s pay at Christmas season from the coffers that are willing to stuff lucre into Fialkow’s jeans? Uplift Atlanta is a new name soon to be memorialized along with dozens of dead plans attempting to disappear Black men from the Sanitized Zone, from the Vagrant Free Zone, from the Safeguard Zone, from the Tourist Triangle and the Peachtree Corridor.

That list of dead things long buried are Debi Starnes’ HAG, Woody Bartlett’s HAP that didn’t live long enough to breathe, Jim Milner’s million dollar ROC (Resource Opportunity Center), CAP’s Wake Up Atlanta where Dave “Great news!” Wardell and APD woke up sleeping homeless people with a prod here and there, Stay Up Atlanta is a new name for Wake Up Atlanta.

Then came the heralded Gateway that defunct Starnes and retired Sibley and accused A. J. Robinson and rock of Rock Hill Richard “Crap sniffer” Orr all herald as the model shelter that would end homelessness in Atlanta. Note: Horace Sibley ended homelessness in Atlanta by redefining it. The only homeless people are the “chronically homeless.” And all the chronically homeless are the imprisoned at Peachtree Pine. Therefore get rid of them and our downtown is rid of the scourge of homeless people.

Now Uplift Atlanta, Inc. bubbles to the surface. It seeps up as the latest effort to disappear homeless people and to destroy the largest community for homeless people in the Southeast? Who is Uplift Atlanta? Who provides the $40,000 per month? Notes on Mercy’s Diane Leavesley’s pad in 2008 said somebody in Atlanta could come up with $1,000,000 in one day in order to buy Task Force notes; perhaps that same $1,000,000 source is the cash cow that now will give TEAM GOLIATH $39,000 a month.

All the above must be a mistake. I think these doers of all good meant to say AIRLIFT Atlanta, Inc. The quickest method to get rid of Anita Beaty and her 700 nuisances is to AIRLIFT them out of Atlanta. The roof of the Peachtree-Pine building is flat; it is 17,800 square feet. There are real plans for roof gardens. But a better plan is helicopter pads. Air routes to Valdosta are open; Birmingham can take a few hundred; the service-resistant recalcitrant ones could be taken straight east to the Atlantic and dropped along with the disobedient, Anita Beaty. These service-resistant ones are the “chronic” that Horace Sibley wants so much to service.

ICHTHUS is the English transliteration of the Greek word for fish. And “fish” since the first century has been a symbol of Christianity and has been held to be sacred by the followers of Jesus. Seven of the twelve disciples were fishermen (Mt 4:18-22; Mk 1:16-20; Lk 5:1-11). Jesus directed his disciples to pay his temple tax with a coin to be found in the mouth of the next fish to be caught. Feeding 5,000 in Mk 6:30-44 and 4,000 in Mk 8:1-10 begins with 5 loaves and 2 fish and 7 loaves and a “few small fish” respectively.

Probably, the primary reason why the fish, ICHTHUS, is one of the strongest symbols of the early church is that the Greek letters, iota, chi, theta, upsilon and sigma, represent the first letters in Greek of the five words for Jesus Christ, God’s Son, Savior. Those five letters in the Greek alphabet transliterate into seven letters in the English transliteration, ICHTHUS. Therefore, in any instance, whenever ICHTHUS is written or spoken the writer or speaker in addition to writing or saying the word “fish” is also saying, “Jesus Christ, God’s Son, Savior.”

In the thousands of pages supoenaed from Central Atlanta Progress and Mercy Housing, Inc, many documents show that the nun-run organization refused to sell the mortgage notes of The Pine directly to Central Atlanta Progress. That refusal got A. J. Robinson scurrying for a buyer that would pass muster with the sometimes cautious nuns.

Somewhere along the way, perhaps along the Peachtree Street way, perhaps a Greek scholar in the Uplift Atlanta, Inc. way, perhaps a clergy person in the sanitized zone way, came up with a new name that would satisfy the sometimes cautious Catholic nuns like Sister Jane Gerety. Manny Fialkow and his fellow conspirators formed ICHTHUS COMMUNITY TRUST, Inc. in Las Vegas, Nevada, not too long before foreclosure.

Solomon teaches his readers that there is nothing new under the sun. Page after page of incriminating documents and deposition after deposition of prominent Atlantans purging themselves in the current lawsuits against the City of Atlanta, Central Atlanta Progress, ADID (Defendants) along with others already named such as Cousin Properties, Inc. and Emory Health Care Inc. show the limitless expanse of evil that follows greed and gluttony.

Of all the lice and TB lies and all the false accusations of poor management and all the neighborhood gossip and blatant propaganda leveled against The Pine, the creation of ICHTHUS by a group of highly questionable corporate types may be the most egregious sacrilege of all the wrongs they have committed. And to think that ICHTHUS may have been used here to assuage nuns in an already sleazy takeoveris remarkable. The line of conspirators already on TEAM GOLIATH stretches around the 94,000 square foot home of the community at The Pine. How much longer will that snake grow? Stand back, Darling!

Ratchet Rob “I’ll turn your water off” Hunter will be deposed at 10 this morning at his OLD stomping grounds, Atlanta City Hall. Hunter served as Shirley Franklin’s Commissioner of the Department of Water Mismanagement. The brightest moments of his tenure were the three times Debi Starnes told him to turn off the water at The Peachtree Pine Community where 700 citizens of Atlanta live. His demise came, however, when he irritated the citizens of Buckhead. There are citizens with rights and there are citizens.

In Atlanta the withholder of water from people who A. J. Robinson says are “down on their luck” gets applause from the warm crowds that Peggy Denby orchestrates from her bunker. But if you buck Buchhead, you’re gone.

Speaking of “gone,” Debi Starnes was deposed yesterday for a second five and a half hours. Among her answers was one in which she said that she is no longer paid by United Way or ADID or CAP. Debi and I frequent the same Tavern. We chatted for a New York minute on December 2. I told her the Task Force Board members wanted to know who pays her now. She told me that her busines pays her now.

This must be true. The way the truth works with Starnes is this. If she makes a statement two or three times, it becomes the truth. Do I see little pointed toes of that doer of all good sticking out from under the bus? Has her scepter as Czar, a broom, been taken away?

In an earlier blog I wrote that Rachet Rob “I’ll turn your water off” Hunter was the first of TEAM GOLIATH champions to fall. He becomes toast on New Years day. Conspiracies make such stangest bedfellows. And sometimes they wind up under the bus together. Watch for more on strange bedfellows.

TEAM GOLIATH giant Debi Starnes will face questions from Baker Donelson Attorney Steve Hall at 10 am on December 15 in Starnes’ home court, Atlanta City Hall. Starnes’ first deposition in September 2009 lasted 5 hours. Starnes had to be reminded numerous times by Baker Donelson Attorney Steve Hall that she was UNDER OATH. How many times will that reminder be necessary tomorrow, December 14, 2010?

Inside Crescent Kick

I know no legal terms. My son, Christian, and his son, Eli, are both Karate BROWNBELTS. They have taught me a few terms. Judge Schwall gave Lawyer Scott Bonder and Ichthus and Manny Fialkow an Inside Crescent Kick to the head in his courtroom Thursday, December 9. I’ll explain later.

By order of Superior Court of Fulton County Judge Craig L. Schwall, Sr., Plaintiff Ichthus Community Trust and the Benevolent Community Investiment Company, Inc., its trustee, agents and attorneys shall appear for a hearing at 2:30pm, December 9 in Courtroom 5E. The public may attend this hearing.

The Order signed by Judge Schwall on December 2, 2010, reads as follows:

“The above referenced consolidated matters have come to the Court on Metro Atlanta Task Force For The Homeless, Inc.’s (the “Task Force”) Emergency Motion to Enforce Order and for Contempt, in which the Task Force seeks to have an expedited hearing on its contention that Ichthus and those have violated the Court’s Order of June 17, 2010, by initiation of a dispossessory action in the Magistrate Court of Fulton County (the “”Dispossessory Action”), seeking to remove the Task Force and Anita Beaty from the Shelter at 477 Peachtree Street. Based on the Court’s understanding that the Magistrate Court Action has been served, that a response will be due within seven (7) days of service, that the Court will hold an emergency hearing on December 9, 2010, which is after the date that response would be due in the Dispossessory Action, and for other good cause:

It is HEREBY ORDERED, that Plaintiff Ichthus Community Trust and the Benevolent Community Investment Company, Inc., its trustee, agents and attorneys, shall take those steps necessary to extend the time for the Task Force, Anita Beaty and any other person or entity from which it seeks to obtain relief to answer or otherwise respond to the Dispossessory Action until ten (10) days after the hearing on the Task Force’s Emergency Motion, through and including at least 19, 2010. All parties and their representatives are further directed to appear before the Court for the hearing on the Task Force’s Emergency Motion on Thursday, December 9, 2010 at 2:30 in courtroom 5E.”

In a layman’s terms, Manny Fialkow’s newly hired attorney, Scott Bonder, has attempted to circumvent the Court’s Order of June 17, 2010. That Order essentially held, is my understanding, that the Task Force and the occupants would and could remain in the building until the ownership is determined in a Court of Law.
Baker, Donelson Attorneys, Steve Hall and Robert Brazier, representing the Task Force countered Bonder’s move by requesting the December 9 hearing. Bonder’s zeal has triggered a Pied Piper effect. He’s now ordered to come before the Judge with a solid lineup following him.

Imagine Steve Riddell ‘s expression when he learned that his fellow TEAM GOLIATH conspirator had caused the tight end to be dragged before the Judge. Reading that Order probably brought to Riddell’s mind the day the Clemson Tigers chased him all over the field as a tight end for the South Carolina Gamecocks. Riddell defends the innocent until proven guilty at Central Atlanta Progress.

Lynn M. Roberson, Esq. of Swift Currie McGhee & Hiers LLP; Ms. Roberson represents ADID, The Atlanta Downtown Improvement District. Scott Bonder, Esq. of the Fried & Bonder law firm represents Ichthus Community Trust . Matthew G. Moffet, Esq. works for Gray, Rust, St. Amand, Moffett & Brieske, LLP; Moffett and friends represent Defendant Manny Fialkow. Robert J. Kaufman, Esq. and friends represent The Benevolent Community Community Investment Company, Inc.

What a lineup for the Philistines, TEAM GOLIATH. You can glory in what’s in a name. Ponder them: Rust, Brieske, Fried. These appellations rival Dickens. Imagine having Fried as your defense attorney! Do you remember Dickens’ Barrister Fogg? Having Fried as your lawyer would be like buying your tires from Iffy Tire Co. in Macon or worshipping at the Jiffy Grill Baptist Church in Lancaster, South Carolina.

Who would have thought that we’re off to witness Little Team David, represented by one law firm, Baker Donelson, take on such corporate monoliths. Steve Hall and Robert Brazier ably represent the Task Force. These two attorneys are alone; nonetheless, they hold five smooth stones.

Note: Watch for a nagging snarl ahead for TEAM GOLIATH, specifically Mercy Housing, Inc. and Mercy Loan Fund, Inc. that could give pause to a jury. Steve Riddell, the former Gamecock tight end, is a Troutman Sanders lawyer, representing Central Atlanta Progress. Back in early 2009 when the nuns and Judith Gould and Diane Leavesley and Pete Walker and Andy Slettebac were having hot discussions with A. J. Robinson, the following emails were written. Robinson, to extend the metaphor, is the quarterback of team conspiracy.

An A. J. Robinson email written on February 20, 2009, to Diane Leavesley (Mercy Housing) and Andy Slettebac (ICE) says, “Here’s our suggested way to proceed with a transaction. Please let me know your thoughts.” The transaction he writes of is the foreclosure on the 477 Peachtree Street property. The Subject line of Robinson’s email reads “Peachtree Pine.”

Mark the shrewd questions of Diane Leavesley’s response; note the caution. Leavesley wrote the following on March 2, 2009. “AJ – While we appreciate your efforts to have a lawyer draw up this agreement; we also had discussed additional information that we had expected to receive from you. We would still ask you to tell us who 477 Peachtree LLC is – so that we know this limited liability company has the capacity to purchase the note. Also, we wanted you to offer a price. We would prefer not begin to negotiating the document until we have a “term sheet”. Would you proceed on these things?”

A. J. Robinson responded within the hour to Diane Leavesley, Monday, March 2, 2009. He copied Andy Slettebac , Director, Institute of Community Economics and Sandy Maben. I quote A. J. Robinson:

“Thanks for your email. . . . first a little explanation. I run a non profit business organization that represents the business community of Atlanta and on this issue I speak for the neighborhood around the shelter and the City of Atlanta. Our first preference would be for the Loan Fund to foreclose on the property and the community is willing to work with you afterwards either to buy you out or produce a developer on the property which would make good use of your investment.

Our second choice would be to buy your notes. 477 was formed specifically as a special entity to do just that. Right now it will have multiple investors from the community but until we know what we are buying, there is no reason to fund 477. That is why we took the approach that we did, no one will buy the notes till we have had a chance to look at the specific rights under the notes, etc. I am happy to introduce to you by phone or in person to the two or three major funders we’ve lined up.

As for price, you can assume we will be buying at your loan balance unless we discover something in the documents that would affect that value. Of course if you want to sell at a lower price, that’s ok with us.

As a side note, the 10million price tag that has been placed on the property is about 7 to 7 and half higher than what it’s probably worth in today’s market. Let me know if you have further questions.”

I mentioned above Attorney Steve Riddell of the prestigious Troutman Sanders Law Firm. Depositions and emails have long ago revealed that 477 Peachtree asked about by the cautious Diane Leavesley is none other than Troutman Sanders who were then and now representing Central Atlanta Progress. The plot thickens and the corruption multiplies with each tick of the clock.

Incidentally: Andy Slettebac is ICE’s answer to CAP’s Dave “Great news!” Wardell. Both are screamers! Notes seized by subpoena from Mercy and ICE show that Slettebac exclaims whenever he scores. He exclaims, “Love it!” Let’s call him Andy “Love it” Slettebac.
